US Senate confirms Jay Clayton as Trump’s intelligence chief

The United States Senate on Tuesday confirmed Jay Clayton as Director of National Intelligence, handing President Donald Trump a permanent head for the nation’s intelligence community amid renewed debate over the 2020 presidential election and preparations for the upcoming midterm elections.

 

Clayton was confirmed in a 51-47 vote, with all Democratic senators voting against his nomination.

 

Following the confirmation, Trump congratulated Clayton in a post on Truth Social, saying, “Jay is outstanding in every way, and will do a spectacular job as Director!”

 

The former chairman of the Securities and Exchange Commission and federal prosecutor succeeds Tulsi Gabbard, who resigned last month, and will oversee the country’s 18 intelligence agencies.

 

Clayton replaces acting Director of National Intelligence Bill Pulte, whose brief tenure drew criticism from lawmakers over his lack of intelligence experience and staff reductions at the Office of the Director of National Intelligence.

 

His confirmation comes amid heightened political scrutiny after Trump renewed his claims that the 2020 presidential election was marred by fraud and released declassified intelligence he claimed pointed to Chinese interference in the election.

 

During his Senate confirmation hearing, Clayton faced questions over whether he believed President Joe Biden legitimately won the 2020 election. While he said Biden had been “certified” as the winner, he declined to directly affirm the election result, telling lawmakers, “I’m not an election denier.”

 

Senate Intelligence Committee Vice Chairman Mark Warner said he remained concerned about whether Clayton would resist political pressure but expressed hope that he would provide stable leadership for the intelligence community.

 

Senate Majority Leader John Thune defended the appointment, citing Clayton’s experience leading the Securities and Exchange Commission and prosecuting financial crime and national security cases.

 

Lawmakers also expect Clayton’s confirmation to revive discussions on renewing Section 702 of the Foreign Intelligence Surveillance Act, which permits U.S. intelligence agencies to collect communications involving foreign nationals overseas without individual warrants. However, any legislative action is not expected before September, as the House of Representatives has adjourned for its summer recess.
